NRA To Sue Feds Over ATF Intimidation Of Gun Sellers

The NRA is set to file a lawsuit challenging a federal “regulation” that requires gun merchants to report sales of more than one firearm directly to the ATF, a policy that is being enforced by harassment and intimidation of gun owners despite the fact that language codifying the measure was rejected by Congress back in April.

“The N.R.A. is bringing the lawsuit in the name of two firearms dealers in Arizona. Its draft complaint, a copy of which was obtained by The New York Times, asks a federal judge in the United States District Court for the District of Columbia to issue an injunction barring enforcement of the rule by the Bureau of Alcohol, Tobacco, Firearms and Explosives,” reports the New York Times.

“N.R.A. has always viewed this as a blatant attempt by the Obama administration to pursue their gun-control agenda through back-door rule making, and the N.R.A. will fight them every step of the way,” said Wayne LaPierre, the executive vice president of the gun-rights group.

The new regulation, which comes into force from August 14, requires all gun sellers in border states to report sales of more than one firearm directly to the ATF within 48 hours. Although reports have focused on high-powered semi-automatic weapons, the ATF letter sent to gun merchants also orders firearms dealers to report to the feds sales of “two or more pistols or revolvers, or any combination of pistols or revolvers totaling two or more.”

      samtman, your facts are wrong, and you lie. You are wilfully ignorant. Gunshows are regulated by precisely the same laws as every other source of firearms. FBI staqtistics prove less than one percent of crime guns are purchased at gunshows.

      As to your false assertion that gunshows are arming the narcotraficantes, google "project gunwalker", then, when you've read all THOSE articles, google "fast and furious". You will find that it is the BATFE that is arming the cartels, to the tune of more than three thousand weapons known to have been sent across the border into Mexico. Since only about five thousand seized weapons have been traceable to US retail US gun sources, that means OUR GOVERNMENT< the very agency charged with regulating firearms sales, has provided more than half of US guns to the cartels. So far, it is known that no less than two, and possibly a third, US agents have been murdered by some of those guns sold through the two projects spearheded by our BATFE. Can you guess how many US agents have been murdered by guns bought at gunshows? Let me put it in round numbers… yeah, a single digit that is really round… a big fat zero. So, we have BATFE scoring two, gunshows scoring zero.

        You're right, but I think you put a few too many "thousands" in there. The traceable guns to US gun retailers is more like a number in the teens. Many of the serial numbers were obliterated making tracing impossible. Also, many of the guns the bad guys had came from places way south and some from way, way east of here. It is / was a sham to call for more gun control. Remember gun control is not about guns, it's about CONTROL.

        You're also right about gun shows. There is NO SUCH THING as a GUN SHOW LOOP HOLE.

        And I heartily agree, I'm keeping my gun. ARMED CITIZENS LIVE FREE!

        And anyone out there who believes as we do, if you are not already a member, join the NRA or some other pro-gun organization. Ideally, join one on the national level ( e.g. NRA, GOA or JPFO) and one on the state level in your state.
        Or just pick one that you believe will do the best to promote the Second Amendment and preserve our RIGHTS, and make a contribution. There are a lot of small organizations and local shooting clubs too, that work in various ways to promote shooting and protect our RIGHTS.

The NRA stood against the gun owners then and gave the admin. some of the powers they have gathered by agreeing with them and not voting against the Patriot Act.     Something like this has already gone all the way to the SC – Printz v. United States (95-1478), 521 U.S. 898 (1997). Basically what the ATF is trying to do is force an unfunded mandate onto the gun sellers. Now the decision above deals with state officers being forced to do federal work but I'm sure a good lawyer can apply the decision to gun sellers as well.

    Good for the NRA but trying to get charges against any government agency is going to be hard. Obama has said he's out of it which is a lie as he did know. Eric Holder knew and yet he denies it. Of course it seems all libs lie so you can't believe it when they say they didn't know about something.       The entire administration, and some in Congress are trying to destroy America and its values. I have never seen a President so bent on ruining the country he represents. He wants to control every aspect of our daily lives, by imposing rules that suffocate our economy, and the pity is he is succeeding. American citizens, need to wake up soon, to stop the way their freedom is being usurped by our own elected Government. It will happen unless we vote in a new slate in 2012. They would change the first amendment to say freedom of speech, press and religion are free as long as it doesn’t offend anyone and it’s approved by the government also there is no public expression of religion unless you’re a Muslim. They think if you ban guns there would be no gun crime. Ask Australia about that. Criminals and terrorist never buy weapons legally. Criminals and terrorist don’t care about law and either steal what they need or buy from other criminals. As long as we have legal gun ownership no country would try to invade us. It held true for us in WWII and it still holds true. The only people who register their weapons are law abiding citizens. After Australia banned guns gun crime went up almost immediately and is higher than it’s ever been. We should not let UN dictate what goes on in our Country. We must fight this treaty it’s not in our best interest. Let your Senators and Congressman how you feel about this treaty it’s a bad idea.

    If these idiots knew anything about guns and the difference between a semi auto and a revolver. A revolver does not require policing your brass. Therefore no evidence of the gun used. A semi leaves brasss everywhere and during the excitement the perp dosen't have time to police. So semis are actually better for law enforcement in catching the perp. They can match the spent casings to the gun used.
